Applicable Law and Jurisdiction

This site is subject to Luxembourg law and is governed, in particular, by the Luxembourg Law of 14 August 2000 on electronic commerce. All disputes which may arise as a result of this site are subject to the exclusive jurisdiction of the Luxembourg District Court in Luxembourg (Tribunal d’Arrondissement de Luxembourg).

Motion-S S.A. is committed to protecting and respecting your privacy. The currently applicable regulations of the European Data Protection Regulation (GDPR) are observed. On this page, we would like to inform you about which data we collect from you and for which purposes we use this data. By agreeing to the following terms and conditions, you give us permission to collect, process, and use your personal data in compliance with the data protection laws.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit www.motion-s.com (the “Site”).

Personal information we collect

When you visit the Site, use the Services or App, register for our newsletter, or download documents, request information, or fill in forms we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Tags,” are electronic files used to record information about how you browse the Site.

Personal information you provide

The information you give us may include your name, email address, telephone number, title, company name, and any additional information you choose to provide. Such information is requested from you when you request information, a trial period of our product or services, or subscribe to our newsletter. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information.

How do we use your personal information?

We use the Device Information that we collect to help us to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site).

Data collection and processing with our products and services

Data collection while using Motion-S Trip Recorder App

All the information collected through the Motion-S Trip Recorder App is fully anonymized. Users are requested, upon downloading the app, to enter a PIN code that links their data collection campaign to a respective Fleet. All data collected is, hence, aggregated under the respective Client’s Fleet ID, which allows providing the data augmentation and profiling insights for the particular project. In order to provide these insights not only at the fleet level but also at the driver/user level, an anonymized device_id is generated upon installation of the App by the user.

During the collection of the trips, the Motion-S Trip Recorder works in the background and activates the GPS sensor when vehicular movement is detected using low-energy sensors. Throughout the trip, the App collects vehicle geolocation (latitude, longitude), speed, and heading, with a frequency of one location update per second. No other data field is collected during the trip. No data is collected when the user is not driving. In particular, the information about activities recognized by the physical activities sensors is not reported to the Motion-S platform.

Data sending through API

Once the trip is finalized, the mobile app sends the full list of locations of the trip via the API using predefined credentials for the customer, including an organization_id, a trip_id, device_id, and anonymized username. No identification information of the user (IMEI, email, etc.) is reported to our platform. All the exchanges between the app and the Motion-S platform are secured via HTTPS.

Linking of the Motion-S anonymized user_id to the real user’s identity

Each user of the mobile app has the possibility to obtain his anonymized username in the Motion-S platform by going to the Settings screen of the app. The final user is, therefore, the only one able to deanonymize his/her data and profiles shown in the Analytics Dashboard. If the Client wishes to build a list of usernames and identities of the mobile app users, it simply has to request to the different mobile app users their username obtained via the Setting screen in the app, ensuring compliance with local data privacy regulations.

Data storage

Both raw data collected from the mobile app and augmented and profiled data obtained after processing in the cloud are stored and backed up in the Motion-S platform. All the data is stored in the European Union territory. The data is kept in the Motion-S platform for the duration of the project with the customer. Upon client request, raw collected data can be deleted once the project ends. Anonymized augmented and profiled data is kept by Motion-S for the purpose of enhancing the performance of its platform and services related to it.

Changes

We may update this policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
